3. User Accounts and Registration

For paid services, the following terms apply:

• All fees are quoted in Philippine Peso (PHP) or US Dollars (USD) unless otherwise specified
• Payment is due according to the schedule specified in your service agreement
• Late payments may incur interest charges at the maximum rate permitted by law
• All fees are non-refundable unless otherwise stated in writing
• We reserve the right to modify our pricing with 30 days' notice for ongoing services

For project-based work, a deposit of 50% is typically required to commence work, with the balance due upon project completion and client approval.

9. Disclaimers and Limitation of Liability

Our total liability for any claims arising out of these Terms shall not exceed the amount paid by you to us for the service in the 12 months preceding the claim.

You agree to defend, indemnify, and hold harmless designpulsex, its subsidiaries, affiliates, officers, agents, employees, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of the Philippines, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in Metro Manila, Philippines.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
